This document sets
out:
a.
The criteria
for selection for the New Zealand Team that will represent New Zealand at
International 420 Class World, Greece,
Junior International 420 Class European Championships,
Croatia.
b.
The
provisions for a Selection Panel, and its functions in relation to the New
Zealand Team.
1. SELECTION
CRITERIA
1.1 Selection
Regatta:
a.
The New
Zealand 420 National Championships is the selection regatta. It will be held at New Plymouth, 21-24
March, 2008.
1.2 Crew
Selection:
a. Up to fourteen crews will be selected.
b. Selection will be made on the basis of the overall finishing order in the selection regatta, save that the first seven open crews and the first seven womenÕs crews will be selected in any event.
c. The only crews eligible for selection will be crews whose members:
i. Are financial members of the Association and financial members of a yacht club affiliated to Yachting New Zealand; and
ii. Meet the eligibility criteria for the selection regatta, and any relevant eligibility criteria for the Junior European Championships, and
iii. Are eligible to represent New Zealand in accordance with ISAF Regulation 19, and
iv. Are New Zealand Nationals or bona fide New Zealand residents, unless the Committee grants a dispensation under 4.
d. If the selection regatta does not constitute a series, the Selection Panel constituted under 2.1 will make a selection taking into account results of the National Championships and schedule other regattas as the selection panel considers appropriate.
1.3 Letter
of Invitation:
a. The AssociationÕs Secretary will, by e-mail, within five working days of selection, invite each selected crew to confirm its membership in the team and request a crew deposit of (the NZ$ equivalent) 250 EUROS being the entry fee to the regatta. If a crew fails to give written confirmation to the AssociationÕs Secretary within the time specified in the e-mail, the crewÕs membership will lapse. If the crew fails to pay the entry fee deposit within the time specified in the e-mail, the crewÕs membership will lapse.
b. If there is not a full complement of crews in the team, then subject to the above provisions, the Selection Panel may in its absolute discretion approve the inclusion in the team of another crew or crews from the crews that participated in the selection regatta. The Selection Panel will, by e-mail, invite the new crew or crews to give written confirmation of its/their membership in the team within a stipulated time.
c.
Written confirmation may be given to
the Secretary by e-mail at snowhansen@internet.co.nz.
d.
The entry fee deposit will be posted
to the Association Treasurer:

This fee is refundable only if a crew
withdraws 4 WEEKS PRIOR TO FINAL COUNTRY REGISTRATION (as specified in the
NOR) WHEN THE TEAM ENTRY PAYMENT
is submitted to the International 420 Assoc. by the NZ 420 Association.
2.1
There will be
an independent Selection Panel. It will comprise three members, two of whom
will be appointed by the chair of the Panel.
2.2
The chair of
the panel will be appointed by the AssociationÕs Committee at least ten working
days before the selection regatta, failing which the chair shall be appointed
by the AssociationÕs chair and secretary as soon as practicable.
2.3
Any changes
to the helmsperson or the other member of the crew occurring after the crews
have been selected will be subject to the approval of the Selection Panel.
2.4
When deciding
to give approval or not to give approval, the Panel shall take into account
whether:
a.
The
replacement has the ability to represent New Zealand with an appropriate level
of distinction; and
b.
The
replacement was a participant in the selection regatta; or
c.
The
replacement will be the best or a better substitute in all the circumstances,
and
d.
Such other
matters as it thinks appropriate.
2.5 The Panel will allow a sailor and his or her chosen replacement a reasonable opportunity to meet the Panel and to put his or her case for approval. The replacement member may attend and speak at the meeting.
2.6 Notwithstanding the provisions of 2.3 and 2.4, where the change of crew occurs because of a disagreement between the crew, and neither member of the crew agrees to relinquish his or her position in the team, the Panel shall:
a. Give both the members of the crew the opportunity to reconcile their differences, and failing reconciliation, shall
b. Rescind the team membership of both, unless it is satisfied that
there is good cause to disqualify only one of them (whether helmsman or the other member of the crew).
2.7
No sailor may
obtain the PanelÕs approval for more than one substitute crew member of a
boatÕs crew.
3.
FORFEITURE
OF PLACE IN TEAM
3.1
Unless the
Committee decides otherwise, a crew will forfeit its position in the team if
either of its members fail within the time allowed by the AssociationÕs
Committee, to pay any sum the Committee requires by way of deposit or
contribution towards the teamÕs costs.
3.2
Unless the
Committee decides otherwise, a crew will forfeit its place in the team if
either of its members fail on the CommitteeÕs request, to sign a good behaviour
bond or to pay any sum required by such a bond within the time allowed by the
Committee.
4.
DISPENSATIONS
AS TO RESIDENCY
4.1 Applications for dispensation must be made in writing to the AssociationÕs secretary. Applications will be determined by the AssociationÕs Committee.
NOTE: Nationality Criteria for ISAF Events (ISAF
Regulation 17.5) will be used, subject to any necessary modifications, to
determine apply to NZ 420 Class Association for dispensation residency: and
applications for dispensation will be considered under Regulation 17.5.
5.
FINALITY
5.1
Decisions of
the AssociationÕs Committee and the Selection Panel will be final.
1.
The
Association needs selection criteria to provide for post selection changes to
selected crew. The Committee
considers that:
a. The members of a crew have a responsibility
to each other and if both wish to remain in the team then in the generality of
cases, they must either make the partnership work or they must pull out so that
one is not favoured over the other.
b. However, occasionally there will be good cause to favour one
over the other, or where a sailor ceases to be available for unforeseen reasons
which the sailor cannot control.
One example in the latter category would be where a sailor (say a member
of the top first male or female crew) is involved in a serious accident or
becomes unwell. In such cases the
remaining member of a crew should have a reasonable opportunity to participate
in a reconstituted pair.
c. As a general proposition preference should
be given to a replacement who sailed in the selection regatta. That outcome would safeguard the
interests of the member who has truly earned a place in the team while taking
into account the hopes and aspirations of those who did not.
d. It is never possible to identify every
situation in advance when it would be appropriate to allow a substitute team
member. Hence, the need for an independent Panel to and some general guidelines
to assist the Panel.
3. In
order not to jeopardise New ZealandÕs participation and standing in future
international events, it is important that team members respect the rules of
the international event and maintain a reasonable standard of behaviour when
attending the event. Accordingly,
the Committee may require team members to sign and comply with a good behaviour
bond.
